Privacy notice for the TCG Merchant demo

Who is responsible

Jan Svejda, a private person founding TCG Merchant with three co-founders, is the controller. Contact: connect@tcgmerchant.eu.

What is measured, and only if you allow it

The demo on tcgmerchant.eu opens only through an invitation link sent to a store. When you choose Allow in the box on the demo, we measure how the demo is used:

• the pages you open, how long you stay, and the steps you take, such as a scan's result, finishing an intake or confirming a trade;
• where you click and how far you scroll (heatmaps);
• a recording of the screen while you use the demo (session replay), in which everything you type is masked;
• your browser, operating system, device type, screen size and language, and the country, region and city derived from your IP address; the IP address itself is not stored;
• your invitation code, which names your store, so that we can see what each store did.

Visits are grouped into a session that starts again every calendar month. No cookie is set for this. Your choice, its date and the version of this notice are kept in your browser's local storage. The invitation cookie that opens the demo is needed to show it to you and is not used for measuring. If you choose Refuse, nothing is measured and nothing is sent to the measuring server; the demo works the same.

Why, and on what basis

To learn how stores use the demo, so that we build the product they need. The legal basis is your consent (Art. 6(1)(a) GDPR, and Art. 5(3) of the ePrivacy Directive as your country implements it). You do not have to consent.

Who processes the data

The measurements are stored by the open-source software Umami on a server we run at Amazon Web Services in Frankfurt, Germany; AWS processes them on our behalf. The demo itself is delivered through Amazon CloudFront. The four founders can see the measurements. The company being founded for TCG Merchant will receive them and take over as controller once it is incorporated; this notice will then name it.

How long

Until the findings from them have been worked into the product after its launch. We review every twelve months whether they are still needed, and then delete them. What we keep after that are conclusions and counts that no longer relate to any person.

Your rights

You can ask for access to your data (Art. 15 GDPR), its correction (Art. 16), erasure (Art. 17), restriction (Art. 18) and a copy to take elsewhere (Art. 20). Tell us your invitation code: the measurements carry no name, and the code is how we find yours (Art. 11(2)).

You can withdraw your consent at any time with Privacy choices at the bottom of every demo page. Withdrawing stops the measuring from then on; it does not make the measuring before unlawful (Art. 7(3)).

You can complain to a data protection authority (Art. 77), for example where you live or the Czech Office for Personal Data Protection (uoou.gov.cz).

Was gemessen wird, und nur mit Ihrer Erlaubnis

Die Demo auf tcgmerchant.eu öffnet sich nur über einen Einladungslink an einen Laden. Wenn Sie im Fenster der Demo Erlauben wählen, messen wir, wie die Demo genutzt wird:

• die Seiten, die Sie öffnen, wie lange Sie bleiben, und Ihre Schritte, etwa das Ergebnis eines Scans, den Abschluss einer Erfassung oder die Bestätigung eines Handels;
• wohin Sie klicken und wie weit Sie scrollen (Heatmaps);
• eine Aufzeichnung des Bildschirms während der Nutzung (Session Replay), in der alles, was Sie eingeben, unkenntlich gemacht ist;
• Browser, Betriebssystem, Geräteart, Bildschirmgröße und Sprache sowie das aus Ihrer IP-Adresse abgeleitete Land, die Region und die Stadt; die IP-Adresse selbst wird nicht gespeichert;
• Ihren Einladungscode, der Ihren Laden nennt, damit wir sehen, was jeder Laden getan hat.

Besuche werden zu einer Sitzung zusammengefasst, die jeden Kalendermonat neu beginnt. Dafür wird kein Cookie gesetzt. Ihre Wahl, ihr Datum und die Version dieses Hinweises werden im lokalen Speicher Ihres Browsers abgelegt. Das Einladungs-Cookie, das die Demo öffnet, ist nötig, um sie Ihnen zu zeigen, und dient nicht der Messung. Wählen Sie Ablehnen, wird nichts gemessen und nichts an den Messserver gesendet; die Demo funktioniert genauso.

Zweck und Rechtsgrundlage

Wir wollen verstehen, wie Läden die Demo nutzen, um das Produkt zu bauen, das sie brauchen. Rechtsgrundlage ist Ihre Einwilligung (Art. 6 Abs. 1 lit. a DSGVO und Art. 5 Abs. 3 der ePrivacy-Richtlinie in der Umsetzung Ihres Landes, in Deutschland § 25 Abs. 1 TDDDG). Sie müssen nicht einwilligen.

Wer die Daten verarbeitet

Die Messungen speichert die Open-Source-Software Umami auf einem Server, den wir bei Amazon Web Services in Frankfurt am Main betreiben; AWS verarbeitet sie in unserem Auftrag. Die Demo selbst wird über Amazon CloudFront ausgeliefert. Die vier Gründer können die Messungen sehen. Die Gesellschaft, die für TCG Merchant gegründet wird, erhält sie und wird mit ihrer Eintragung Verantwortliche; dieser Hinweis nennt sie dann.

Wie lange

Bis die Erkenntnisse daraus nach dem Start in das Produkt eingeflossen sind. Alle zwölf Monate prüfen wir, ob sie noch nötig sind, und löschen sie dann. Danach behalten wir nur Schlussfolgerungen und Zahlen, die sich auf keine Person mehr beziehen.

Ihre Rechte

Sie können Auskunft (Art. 15 DSGVO), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18) und eine Kopie zur Mitnahme (Art. 20) verlangen. Nennen Sie uns Ihren Einladungscode: Die Messungen tragen keinen Namen, und über den Code finden wir Ihre (Art. 11 Abs. 2).

Sie können Ihre Einwilligung jederzeit über Datenschutz-Einstellungen unten auf jeder Seite der Demo widerrufen. Der Widerruf beendet die Messung ab diesem Zeitpunkt; die Messung davor bleibt rechtmäßig (Art. 7 Abs. 3).

Sie können sich bei einer Datenschutzaufsichtsbehörde beschweren (Art. 77), etwa an Ihrem Wohnort oder beim tschechischen Amt für den Schutz personenbezogener Daten (uoou.gov.cz).

Co se měří, a jen s vaším svolením

Demo na tcgmerchant.eu se otevírá jen přes pozvánku zaslanou obchodu. Když v okně dema zvolíte Povolit, měříme, jak se demo používá:

• stránky, které otevřete, jak dlouho na nich zůstanete, a kroky, které uděláte, například výsledek skenu, dokončení příjmu nebo potvrzení obchodu;
• kam klikáte a jak daleko posouváte stránku (teplotní mapy);
• záznam obrazovky během používání dema (záznam relace), ve kterém je vše, co napíšete, skryto;
• váš prohlížeč, operační systém, typ zařízení, velikost obrazovky a jazyk a zemi, region a město odvozené z vaší IP adresy; samotná IP adresa se neukládá;
• váš kód pozvánky, který jmenuje váš obchod, abychom viděli, co který obchod dělal.

Návštěvy se spojují do relace, která začíná znovu každý kalendářní měsíc. Žádné cookie se k tomu nenastavuje. Vaše volba, její datum a verze těchto informací se ukládají v místním úložišti vašeho prohlížeče. Cookie pozvánky, které demo otevírá, je nutné k jeho zobrazení a k měření se nepoužívá. Zvolíte-li Odmítnout, nic se neměří a nic se neposílá na měřicí server; demo funguje stejně.

Proč a na jakém základě

Abychom pochopili, jak obchody demo používají, a postavili produkt, který potřebují. Právním základem je váš souhlas (čl. 6 odst. 1 písm. a) GDPR a čl. 5 odst. 3 směrnice o soukromí a elektronických komunikacích, jak ji provádí vaše země). Souhlas dát nemusíte.

Kdo údaje zpracovává

Měření ukládá open-source software Umami na serveru, který provozujeme u Amazon Web Services ve Frankfurtu nad Mohanem; AWS je zpracovává naším jménem. Samotné demo se doručuje přes Amazon CloudFront. Měření vidí čtyři zakladatelé. Společnost, která se pro TCG Merchant zakládá, je po svém vzniku převezme a stane se správcem; tyto informace ji pak uvedou.

Jak dlouho

Dokud se zjištění z nich po spuštění nepromítnou do produktu. Každých dvanáct měsíců posoudíme, zda jsou ještě potřeba, a pak je smažeme. Poté si ponecháme jen závěry a počty, které se už netýkají žádné osoby.

Vaše práva

Máte právo na přístup k údajům (čl. 15 GDPR), jejich opravu (čl. 16), výmaz (čl. 17), omezení zpracování (čl. 18) a kopii k přenesení jinam (čl. 20). Sdělte nám svůj kód pozvánky: měření nenesou jméno a podle kódu najdeme ta vaše (čl. 11 odst. 2).

Souhlas můžete kdykoli odvolat přes Nastavení soukromí dole na každé stránce dema. Odvolání ukončí měření od té chvíle; měření předtím zůstává zákonné (čl. 7 odst. 3).

Můžete podat stížnost u dozorového úřadu pro ochranu osobních údajů (čl. 77), například v místě svého bydliště nebo u Úřadu pro ochranu osobních údajů (uoou.gov.cz).
